Standing Up For the Rights of Professional Malpractice Victims

DubiLaw is an experienced litigation firm well versed in all types of professional malpractice claims. Richard A. Dubi, Esq. knows that doctors, dentists, accountants, engineers and other professionals are human and occasionally make mistakes. But when they do, their patients or clients can suffer enormous physical, psychological and economic damage. They deserve to be compensated for their losses. As a boutique litigation firm, DubiLaw has the expertise and trial experience to vigorously and successfully represent clients in a wide range of professional malpractice areas including:

  • Medical, including doctor, dentist, hospital
  • Nursing home abuse and neglect
  • Accounting
  • Engineering and architectural
  • Legal

Medical Malpractice

Medical errors can occur in a doctor’s office, dentist’s office, or hospital, be it the emergency room, surgical suite, intensive care unit, birthing center or elsewhere. A 2016 study led by the Johns Hopkins University School of Medicine found that medical errors result in up to 251,000 deaths per year.

Richard A. Dubi, Esq. knows that for a medical malpractice lawsuit to be successful, the plaintiff must prove that the health care professional and/or facility deviated from accepted medical or dental standards of practice. DubiLaw therefore takes the time to have its clients’ medical records reviewed and evaluated by independent experts. With over 25 years of successful medical malpractice litigation, DubiLaw is proud to have obtained such results as these:

  • $1.4 million for improperly setting a fractured wrist, leading to permanent disability of the patient’s hand
  • $750,000 for disfiguring injuries due to improperly performed plastic surgery
  • $500,000 for failing to properly reset a dominant thumb, causing disability of the patient’s hand
  • $475,000 for conscious pain and suffering
  • $425,000 for improper spinal fusion
  • $325,000 for improper surgery leading to death
  • $250,000 for failing to do proper testing prior to knee surgery, leading to cardiac arrest

Nursing Home Abuse and Neglect

Richard A. Dubi, Esq. understands that one of the most difficult decisions any family faces is that of placing an elderly loved one in a nursing home. When the loved one then suffers abuse or neglect at the hands of those to whom the family has entrusted his or her care, the results can be devastating, not only to the elderly patient, but also to the family. DubiLaw is proud to have successfully fought for the rights of numerous patients and their families to receive compensation from nursing homes that render substandard, neglectful care.

Accounting Malpractice

Richard A. Dubi, Esq. is a CPA as well as an attorney, giving him the education, background and experience necessary to analyze and understand complex financial records and tax issues. DubiLaw has successfully handled many accounting malpractice cases on behalf of clients who suffered economic loss as the result of an accountant’s failure to properly prepare and file personal, corporate and/or estate tax returns. In one notable lawsuit against an accounting firm that failed to timely file an estate tax return, resulting in interest and penalties being assessed against the estate, DubiLaw was able to restore the estate to wholeness by recovering $1.25 million in damages.

Engineering and Architectural Malpractice

Engineers and architects are required to take reasonable care in providing the services they perform for their clients. Reasonable care means that degree of care which a reasonable, prudent engineer or architect of similar training would render in providing similar services in a similar undertaking. DubiLaw has extensive experience representing clients who were damaged as a result of engineering or architectural malpractice. These professionals may be liable for a failure to use reasonable care in the design, consulting or advising on any building project, such as:

  • Failure to consult appropriate guidelines to determine weight loads, structural integrity or other characteristics of building materials
  • Failure to take appropriate weather, sub-strata, environmental or similar factors into account in the design or engineering of a project
  • Failure to properly supervise workers in the performance of tasks on a project

Legal Malpractice

DubiLaw is never eager to sue a fellow lawyer. However, Richard A. Dubi, Esq. adheres to the highest ethical standards of legal practice and strongly believes that other attorneys must do likewise. Attorneys are bound by a code of ethics and may be sued to recover compensation for any breach of that code, including the following:

  • Failure to file documents in a timely manner, such as failing to file suit within the applicable statute of limitations or failing to meet court-imposed deadlines
  • Failure to know and/or apply the law
  • Negligent investigation and/or discovery
  • Misuse of escrow funds
  • Conflict of interest

Legal malpractice actions often are called “a case within a case” because one of the things the plaintiff must prove is that he or she would have won their original case but for the negligence of the attorney or law firm that handled it. Legal malpractice lawsuits consequently are very complex. Not only must the plaintiff prove that the attorney breached his or her duty, the underlying case also must be retried. Where an instance of clear attorney negligence has occurred, DubiLaw has the experience necessary to aggressively advocate for the rights of their clients to seek monetary damages as compensation for such legal malpractice.
